TALLAHASSEE, Fla. (AP) — Gov. Ron DeSantis signed a bill Friday that sets is kratom legal in florida first strictures on the sale of kratom, a relative of the coffee plant that has been used as a euphoric pain reliever for centuries. The measure, known as the “Florida Kratom Consumer Protection Act,” makes it a misdemeanor for anyone to sell the substance to people under 21, and defines what constitutes kratom products in state statutes. It also calls for kratom products to include potency labels and suggest a serving size or dosage. The measure also bars a kratom product from making any claims that it is intended to treat, cure or prevent a medical condition or disease.

It also requires kratom products to be packaged in child-resistant containers. The bill, which takes effect July 1, also prohibits a person from importing or shipping kratom products to Florida, and it gives the state Department of Agriculture and Consumer Services broad authority to regulate the herb. Erin Moffet, a spokesperson for the department, says that without additional resources and guidance on contaminant limits, the agency does not have the ability to test kratom as the bill would require.
The law’s supporters say the plant has been linked to a handful of deaths, but medical examiners have found that in almost all of those cases, kratom was combined with other drugs like heroin, cocaine and fentanyl. Caleb Curl, who owns Kameleon Kava & Coffee in Tallahassee, says he agrees with the law’s aim to restrict the sale of kratom to those over 21. But he worries that the new rules will have unintended consequences.
